General Terms and Conditions (GTC) of Lenz Ges.m.b.H.

Scope and Contracting Parties

These GTC apply to all contracts between Lenz Ges.m.b.H. (hereinafter “Lenz” or “Seller”) and consumers. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their commercial or independent professional activity.

Our online shop is directed exclusively at consumers (B2C). Sales to entrepreneurs within the meaning of the Austrian Commercial Code (UGB) are excluded. Orders placed with a VAT ID or company name do not establish an entrepreneur contract.

Any deviating conditions of the consumer are not accepted.

Conclusion of Contract

The presentation of products in the online shop does not constitute a binding offer. By submitting the order, the consumer makes a binding offer to purchase.

The ordering process includes the following steps:

  • Selection of goods
  • Adding items to the shopping cart
  • Entering billing and delivery details
  • Selecting the payment method
  • Reviewing order data
  • Submitting the order by clicking the “Buy Now” button or a comparable definitive order confirmation

The contract is concluded only upon our order confirmation – for example in the form of a confirmation email.

The contract text is stored by us. Order data and these GTC will be sent to the customer by email.

Prices, Payment and Invoice

All prices include statutory value-added tax.

For deliveries to other EU member states, taxation is carried out in accordance with applicable EU VAT regulations (OSS scheme).

Payment can be made via PayPal, SOFORT transfer, credit card, Apple Pay, or Google Pay.

After ordering, you will receive an invoice by email containing all relevant order data (order number, items, quantities, prices, shipping costs, payment details, etc.). Please retain the invoice as proof of purchase.

Unless otherwise agreed, the invoice amount is due within 14 days of the invoice date without deduction. Bank transfer fees are borne by the buyer.

Delivery and Shipping Costs

  • Shipping: Goods in stock are generally shipped on the same or next business day.
  • Delivery time: In Austria and Germany, delivery usually takes 2–3 business days (depending on the shipping partner).
  • Shipping costs: For deliveries to Austria we charge €4.99, to Germany €6.50. Orders over €70 are shipped free of charge (to Austria and Germany).

Partial deliveries are permitted insofar as they are reasonable for the consumer.

If a product is permanently unavailable, we will inform the customer immediately and refund any payments made without undue delay.

Retention of Title

The goods remain our property until full payment has been received.

Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. The period begins on the day the goods (or a partial delivery) are received.

To exercise the right of withdrawal, you must inform us (Lenz Ges.m.b.H., Staudachstraße 3, 6858 Schwarzach, Austria; Fax +43 5572 58143-33; email: shop@lenzproducts.com) by means of a clear declaration (e.g. letter, fax, or email) of your decision to withdraw from the contract.

  • Return: Please return the goods as soon as possible and no later than 14 days after submitting the withdrawal declaration. Return shipping costs are borne by the consumer.
  • Refund: After receipt of your withdrawal declaration, we will refund all payments (including standard shipping costs) without undue delay and at the latest within 14 days.

We may refuse the refund until we have received the goods back or until the consumer has provided proof of dispatch, whichever is earlier.

Warranty and Guarantee

Statutory warranty rights for consumers under the Austrian Consumer Warranty Act (VGG) apply.

Lenz grants a manufacturer’s guarantee of 2 years from the date of purchase (EU). This guarantee does not limit statutory warranty rights.

Within the scope of the statutory warranty, repair or replacement of the goods may be carried out. Please contact our service for this purpose.

Liability

We are liable without limitation for damages arising from injury to life, body, or health, as well as in cases of intent or gross negligence.

In cases of slight negligence, liability is limited to the foreseeable damage typical for the contract.

Any further liability is excluded to the extent permitted by law.

Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Your statutory warranty rights remain unaffected.

Applicable Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not restrict mandatory statutory provisions of the country in which the consumer has their habitual residence.

Information on the processing of personal data can be found in our privacy policy on our website.

Severability Clause

If individual provisions of these GTC are or become invalid, the validity of the remaining provisions shall remain unaffected.
